These terms and conditions set out the terms of use of Pledgecom, websites, mobile applications, or any other application running in the Pledgecom ecosystem. By browsing the websites or mobile app, downloading the mobile app, or registering accounts you acknowledge that you have read and that you have agreed to be bound by these terms and conditions and to follow them at all times

By using or otherwise accessing the Services, or clicking to accept or agree to these Terms where that option is made available, you accept and agree to these Terms and consent to the collection, use, disclosure, and another handling of information as described in our Privacy policy and agree to and accept any additional terms, rules, and conditions of participation issued by Pledgecom from time to time. Pledgecom reserves the right, at its sole discretion, to modify or replace the Terms of Service at any time. The most current version of these Terms will be posted on our site. Use of the Services by you after any modification to the Terms constitutes your acceptance of the Terms of Use as modified.

Pledgecom is a global platform and by accessing the Content or Services, you represent and warrant that you are of the legal age of majority in your jurisdiction as required to access such Services and Content and to enter into agreements as required by the Service. You also represent that you are legally authorized to use the Service in your jurisdiction, including holding cryptographic tokens of value and interacting with the Services or Content in any manner. You also represent that you are responsible for ensuring compliance with the laws of your jurisdiction and acknowledge that pledgecom is not responsible for your compliance with such laws.
Limitation of Liability
We provide the service without any guarantees or warranties. Whilst we ensure that the content of the website or mobile app is correct, we are not responsible if it is not correct. We do not guarantee or represent that any information, content, advertisements, or any other website or mobile app that you may access through our website or mobile app is accurate or reliable or that it meets your requirements.

We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, and any term as to the provision of services to a standard of reasonable care and skill or as to non-infringement of any intellectual property right.

We do not accept responsibility for any defects which may exist, or for any costs, loss of profits, loss of data, or consequences arising from your use of, or inability to access the website or mobile app

We do not accept any responsibility or liability for enabling you to link to any other website or mobile app, or for the contents of any other website or mobile app, whether one from which you may have been linked or to which you may link from the website or mobile app, or for any consequence of your acting upon the contents of such website or mobile app.

We do not accept any liability for your dealings or contracts via the service with other users of the Service or any other third party

We do not accept any liability (whether in contract, tort, or otherwise) for any acts or omissions resulting from your decision formed based on your use of the service.

Events Beyond Your or Our Control

Neither you nor we shall be liable to the other for any delay or failure to comply with our respective obligations under these terms and conditions if the delay or failure arises from any course that is beyond our reasonable control, including (without limitation) any act of God, or Government or Regulatory Authority or other internet service providers, war, terrorism or non-availability or mail functioning of a telecommunications or broadcast or other network system or service.

Pledgecom assumes no responsibility, and shall not be liable for any damages to, or viruses that may infect your computer, telecommunication equipment, or other property caused by or arising from your access to use of, or browsing the Site or your downloading of any materials, from the Site.
You must compensate us for any damage, which we suffer because of something you have done or in the event of your breach of these terms and conditions.
Access to Services
We cannot guarantee that our services will be uninterrupted and error-free. We cannot be liable if we are unable to provide our service for any reason beyond our control.

Pledgecom Labs disclaims liability for any coding or system bugs and for any full or partial disruption of service delivery, which is provided on a “best efforts” approach.

Your access to the Service may be restricted from time to time to allow for repairs, maintenance, or the introduction of new facilities or services. If this happens, we will attempt to restore the Service as soon as reasonably possible.
Limitations on use of the Service
- You agree that you and you alone are the exclusive owner of this account and the pledge token associated with your account and that you will not transfer your account to any other person, group, or organization
- You acknowledge and agree to the condition that you register on the network with only one account and one device. you must follow the KYC procedure if needed. Users who have opened multiple accounts on multiple devices, run bots, engaged in the operation of automated bots, or distributed materials on any platform that are deemed defamatory or detrimental to the reputation and interests of the Pledgecom project, will face immediate account termination without prior notice.
- You agree not to engage in any illicit and/or illegal transactions using Pledge tokens
- You agree not to engage in, or attempt to engage in activity that seeks to defraud us or any other person or entity, including, but not limited to, providing any false, inaccurate, or misleading information to unlawfully obtain the property of another
- You agree not to engage in activity that transmits, exchanges, or is otherwise supported by the direct or indirect proceeds of criminal, terrorist, or fraudulent activity
Violation of any of these terms may result in the invalidation of your account and forfeiture of your entire balance. You agree that you assume full responsibility in the event of invalidation of your account and cancellation of your balance. Pledgecom Labs, Pledgecom app, and its developers bear no liability if your account is invalidated, your balance is canceled or if transferred Pledge tokens are canceled.
Links
The Service may provide, or third parties may provide, links to other internet websites mobile apps, or resources. Because we have no control over such website or mobile apps and resources, you acknowledge and agree that we are not responsible for the availability of such external website or mobile apps or resources, and do not endorse and are not responsible or liable for any content, advertising, products, or other materials on or available from such website or mobile apps or resources.

We will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such website or mobile app or resource
Suspension or termination of Our Services
We may suspend, restrict, reduce, or terminate the Service to you immediately without any compensation if you breach any of these terms.
Website and Application Security
You acknowledge that blockchain applications are code subject to defects and acknowledge that you are solely responsible for evaluating any code provided by the Services or Content and the reliability of any third-party websites, products, smart contracts, or Content that you access or use through the Service.

You also expressly acknowledge and represent that blockchain applications developed by third parties may be written with malice or negligence, that pledgecom cannot be held liable for your interaction with such applications, and that such applications may cause loss of ownership or even identity. This warning and others subsequently provided by pledgecom do not constitute, and in no way constitute, a continuing obligation to advise you of all potential risks of using the Services or third-party mobile applications.
Volatility of Crypto Currencies
By accepting the Terms of Service you understand that blockchain technologies and associated coins or tokens are highly volatile due to many factors, including but not limited to adoption, speculation, technological, and security risks.

You also recognize that once the pledge token goes live or Pledge is listed on an exchange, Pledge will experience similar volatility and will be subject to the same factors faced by other cryptocurrencies. Recognize also that the cost of transactions on such technologies is variable and can increase at any time, causing an impact on any activities that take place on blockchains.

You acknowledge these risks and represent that Pledgecom cannot be held liable for such fluctuations or increased costs.
Proprietary Rights
You acknowledge and agree that the Service, website, mobile application, their design, code, network architecture, all software products that are contained on the website or mobile application, and graphics, are subject to intellectual property rights that are owned by pledgecom and its Licensors and are protected by applicable intellectual property and other laws. Unless you are expressly authorized by pledgecom, you agree not to copy, modify, rent, lease, loan, sell, distribute, perform, display, or create derivative works based on the Service or Content, in whole or in part.

Pledgecom’s trademarks and the Pledge design (the “Trademarks”) are trademarks of Pledgecom Labs and its parent company. You may not use the Trademarks without Pledgecom’s prior written permission.
Risk of Regulatory Actions
You acknowledge and understand that pledgecom and the cryptocurrencies you store on pledgecom may be affected by one or more regulatory actions, which may prevent or limit pledgecom’s ability to continue to develop, or which may prevent or limit your ability to access or use the Service
Statute of Limitations
You agree that any claim or cause of action arising out of or related to the use of the Service or the Terms must be filed within one (1) year after such claim or cause of action arose, or another period as provided under statute or law, or be forever barred.
Governing Law
This Agreement is governed by British Virgin Islands law, without regard to conflicts of law principles. The exclusive jurisdiction and venue for disputes under or relating to the Agreement are the District Court of the Virgin Islands, BVI. You consent to jurisdiction and venue in such courts.
